The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 of the Indian Penal Code.
The allegation against unknown miscreants is that they arrived at the home of the informant where the informant and other were residing and then the said miscreants on pistol point looted cash of total one lakh sixty seven thousand seven hundred Rs. (1,67,700/-) and mobile phones from the informant and his companion after that miscreants fled away.
Patna High Court CR. MISC. No.10065 of 2023(2) dt.03-05-2023 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of confessional statement of co-accused. Neither the petitioner is named in the FIR nor he was put on TIP. Similarly situated co-accused has already been granted bail by a coordinate Bench of this Court vide order dated 11.01.2022 passed in Cr. Misc No. 45085 of 2021. It is further submitted that nothing looted article has been recovered from the conscious possession of the petitioner moreover, the petitioner is languishing in judicial custody since 19.02.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sherghati Dhobi P.S. Case No. 117 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
