Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 379, 411, 279 and 337 of the Indian Penal Code, registered in connection with Shiv Sagar (Baddi) P.S.Case No. 44 of 2021.

As per allegation, the accused persons including the present petitioner was taking away the buffalo of the informant by a pick-up van. Punam Devi, who is sister-in-law of the informant, sustained injury in her wrist as she came in contact of

Patna High Court CR. MISC. No.7574 of 2022(2) dt.29-08-2022 2/2 that pick-up van. Co-accused Nirbhay Kumar was arrested at the spot, whereas the petitioner became successful in fleeing away. The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession and he is a person of clean antecedent.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Sasaram in connection with Shiv Sagar (Baddi) P.S.Case No. 44 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
