JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-06-2019 Learned counsel for the petitioner submits that being aggrieved by the selection procedures adopted by the Selection Committee presided by the District Magistrate, Kaimur at Bhabua, he has submitted an objection before the District Magistrate vide Annexure-5 to the writ application which has not been looked into as a result whereof the petitioner has moved this Court. Learned counsel submits that, in the given

Patna High Court CWJC No.3402 of 2019(2) dt.28-06-2019 2/2 facts and circumstances of the case, this writ application may be disposed off with a direction to the District Magistrate, Kaimur at Bhabua to consider his objection and take an appropriate decision thereon within a reasonable time.

Learned counsel for the State has no objection to the same.

In the given facts and circumstances of the case, the District Magistrate, Kaimur at Bhabua (respondent no.5) is hereby directed to look into the grievance of the petitioner as contained in Annexure-5 to the writ application, examine the same and pass an appropriate order thereon within a period of three months from the date of receipt/production of a copy of this order.

It goes without saying that in case the respondent no.5 proposes to pass any order adverse to the interest of the private respondent no.11, he would be under obligation to hear the respondent no.11 as well before passing such order.
