The petitioner seeks bail in Sarmera P.S. Case No. 90 of 2013 registered under section 307 and other allied sections of the Indian Penal Code and 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is alleged to have fired which hit on the chest of Mahendra Rawat. The doctor has found 1⁄2" x 1/3" muscle deep injury over left side of chest. The injury appears to be simple. But from the X-ray report it appears that bullet was found stuck in between the two ribs on the chest. Shot was hit on the vital part of the body and the injured had providential escape. Considering the facts and the circumstances of
Patna High Court Cr.Misc. No.42255 of 2014 (3) dt.12-02-2015 2/2 the case, I am not inclined to grant bail to the petitioner. The same is rejected. The petitioner may renew his prayer for bail after remaining nine months in jail custody.
