2. The petitioner apprehends his arrest in Complaint Case No. 2776 of 2019 registered for the offences punishable under Section 323, 406, 420, 506/34 of the Indian Penal Code pending in the Court of learned Chief Judicial Magistrate, East Champaran, Motihari.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.9180 of 2023(3) dt.24-08-2023 2/2 learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that the petitioner has not received any amount from the complainant.
