JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim has renewed his prayer for anticipatory in a case registered for the offences punishable under Sections 498A, 304B and 201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture and killing the daughter of the informant within three months of the marriage for non-fulfillment of the dowry demand.

The prayer for anticipatory bail was earlier rejected vide order dated 27.06.2014 passed in Cr. Misc. No. 7761 of 2014 by a co-ordinate Bench of this Court (now retired). It is submitted by learned counsel for the petitioner that at the time of occurrence the petitioner was at Delhi and the victim died at her native place. Moreover, the informant has subsequently

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ara Mufassil PS. Case No. 225 of 2013 pending in the court of learned JM, 1st Class, Ara Bhojpur. Accordingly, the application is disposed of.
