1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Complaint Case No. 279 of 2020 dated 10.09.2020 registered for the offence(s) punishable under Section(s) 498(A) and 323 of the Indian Penal Code.

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is husband of the complainant and he has been languishing in jail since 14.10.2022 and the instant matter is based on the complaint filed by the petitioner's wife, though the complainant made allegation of physical cruelty against the petitioner but no documentary

Patna High Court CR. MISC. No.7438 of 2023(2) dt.29-04-2023 2/2 evidence was produced before the trial court and after cognizance, the trial court issued summons to get appearance of the petitioner and thereafter the petitioner himself surrendered before the trial court but he was denied bail.

4. Learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions and mainly the petitioner's custody period and also the facts that the instant matter is based on complaint and after cognizance, the petitioner himself surrendered before the trial court but he was denied bail, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail in connection with Complaint Case No. 279 of 2020 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
