The petitioner seeks bail in Bihariganj P.S. Case no. 53/2015, registered for the offences punishable under Sections 392, 394 of the Indian Penal Code and 27 of the Arms Act. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Ashish Jha. Looted motorcycle was recovered near a pipal tree. Save and except the confessional statement of co-accused, there appears no tangible evidence.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.43368 of 2015 (2) dt.18-09-2015 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Udakishunganj, Madhepura, in connection with Bihariganj P.S. Case no. 53/2015.
