The petitioners apprehend their arrest in connection with Mushahari P.S. Case No.155 of 2021, registered for the offences punishable under Sections 448, 341, 323, 325, 324, 307, 379, 427, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioners are innocent and have falsely been implicated in the present case. It is further submitted that there is general and omnibus allegation against the petitioners. It is also submitted that there is land dispute between the parties. It is lastly submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail petition.

Patna High Court CR. MISC. No.7250 of 2022(2) dt.01-08-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts and circumstances of the case, let petitioner no.1, namely, Ranjeet Mahto, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-10th, Muzaffarpur in connection with Mushahari P.S. Case No.155 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

The prayer for anticipatory bail of petitioner no.2, namely, Sanjeet Mahto is rejected.
