JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Phulwari Sharif P.S. Case No. 1099 of 2019 for the offence under Sections 147, 148, 149, 337, 338, 307, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is a trader. He further submits that he has been made accused in the instant case only on the basis of suspicion that he was involved in participating in activities disturbing communal harmony.

Noticing the allegation causing communal disharmony, the Court is constrained to grant anticipatory bail on the stringent condition that the petitioner named above, in the event

Case No. 1099 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
