Patna High Court MJC No.277 of 2023(4) dt.12-04-2023 2/2 APP for the State.

This application has been filed for modification of the order dated 24.11.2022 passed by this Court in C.W.J.C No. 14792 of 2022 by fixing time limit for disposal of the matter by the Divisional Commissioner, Patna.

This application is disposed of with an observation that the arbitration proceeding which has been initiated before the Divisional Commissioner, Patna shall be completed within three months from the date of receipt/production of a copy of the order. The Divisional Commissioner, Patna will proceed with the arbitration within the aforesaid period even if either of the parities does not cooperate.

The contention of the petitioners is that the land in question is a commercial land which is supported by Annexure 1 and 8. This fact will be considered by the Arbitrator in accordance with law while deciding the arbitration proceeding. (Sandeep Kumar, J) Harsh/ U T
