Mr. Dinesh Jha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner, learned counsel for the informant/complainant and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 323, 354(B), 376, 511 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant/complainant alleges that the accused persons, including the petitioner, entered her house on 27.02.2022 and the petitioner sexually assaulted her while other accused

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that on account of dispute relating to land, the present false case came to be instituted, it is further submitted that it absolutely does not stand to reason that the petitioner in presence of his wife and mother, who are also accused in the present case, would have committed such an occurrence. It is further submitted that even from perusal of the allegations as alleged in the FIR, the same does not inspire confidence that the informant/complainant was sexually assaulted.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.8255 of 2023(3) dt.06-07-2023 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Barhat P.S. Case No. 40 of 2022 arising out of Complaint Case No. 223C/2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
