Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

From the house of the petitioner occupied by other family members also, liquor was recovered. Petitioner is in custody since 21.12.2020. Petitioner has stated on oath that he has got no criminal antecedent.

Submission is that the recovery is not from conscious possession of the petitioner.

Considering the submission aforesaid and completion

Patna High Court CR. MISC. No.20838 of 2021(2) dt.23-08-2021 2/2 of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Maheshkhunt Police Station Case No.148 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
