The petitioner is languishing in jail since 15.06.2015 in a case instituted under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per prosecution case that the informant demanded his dues money from the petitioner and co-accused over which they called him, drank with the informant and while the informant was going away then the petitioner caused fire arm injury on the chest and waist of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.06.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of
Patna High Court Cr.Misc. No.43728 of 2015 (3) dt.30-11-2015 evidence against the petitioner. Petitioner has got no criminal antecedent. General and omnibus allegation has been made against him. No specific injury has been attributed against him. From perusal of Annexure-2 and 2/1, it would appear that the injuries are simple in nature.
On behalf of the State and counsel for the informant, it has been submitted that the petitioner is named in the FIR. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Khagaria in connection with Pasraha P.S.Case No.64 of 2015, G.R.No.1318 of 2015.
