JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Mokamah P.S. Case No. 252 of 2019, registered for offences punishable under Sections 149, 341 and 302 of the Indian Penal Code.
Prosecution case is that son of the informant has been apprehended by the accused persons including petitioner and 10 to 15 unknown persons in the village Mor and he has been brutally assaulted by them and he was taken to hospital by the police but in course of treatment, he died.
It has been submitted on behalf of the petitioner that though the petitioner has been named in the F.I.R, no specific allegation has been attributed to him. Further he has no criminal antecedent and he has been in judicial custody since 29.10.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Barh in connection with Mokamah P.S. Case No. 252 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
