The petitioners seek bail in a case registered for the offences punishable under Sections 307, 325 and other Sections of the Indian Penal Code.
Chetan Kumar the petitioner no. 2 is alleged to have twisted the arm of the informant Shivnarayan Yadav causing fracture injury. Sushil Yadav, petitioner no. 3 and Jairam Yadav are alleged to have assaulted Santosh Yadav. Dhirendra Yadav and Hari Yadav, petitioner no. 1 are alleged to have assaulted Sanjay Yadav. The informant got fracture injury on arm. Santosh Yadav got grievous injury on index finger and injury on head occipital region is opined to be grievous. Sanjay Yadav also got
Patna High Court Cr.Misc. No.45329 of 2015 (2) dt.01-10-2015 2/2 injuries on temporal region and opined to be grievous and another found is on shoulder is opined to be simple in nature. The informant has not made any specific allegation that who caused the injury found on temporal region of Sanjay Yadav. The occurrence took place on account of land dispute. The petitioners have remained in jail since 06.08.2015.
Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Madhepura (Bharrahi) P.S. Case No. 150 of 2015.
