Heard learned counsel for the petitioner and learned APP for the State.

The petitioner in the present case is seeking modification of the order dated 23.11.2021 passed in Cr. Misc. No. 7111 of 2021 for extending the period of surrender. Learned counsel for the petitioner submits that the petitioner was granted anticipatory bail by this Court vide order dated 23.11.2021 passed in Cr. Misc. No. 7111 of 2021 in connection with Banka P.S. Case No. 108 of 2020 to the satisfaction of C.J.M Banka with a direction to surrender within four weeks.

Patna High Court CR. MISC. No.15798 of 2022(2) dt.28-09-2022 2/2 Learned counsel submits that the father of the petitioner had died and for that reason he could not surrender within the given period.

Learned APP for the State has not opposed the prayer of the petitioner.

Having regard to the submission that the father of the petitioner had died and for that reason he could not surrender within the given period, this Court directs that in case the petitioner surrenders and furnishes the bail bond within six weeks from today, he will get the privilege of anticipatory bail in terms of the order dated 23.11.2021 passed in Cr. Misc. No. 7111 of 2021.

This application stands disposed of accordingly. Certified copy of the order will be made available only after removal of the defects.
