According to the prosecution case itself, alleged occurrence took place on 2.7.2012 but complaint case was filed on 8.11.2012 i.e. after cremation of the dead body. The aforesaid complaint case was sent to the police station where first information report was lodged. It appears that there was previous enmity between the parties.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate II, Saran at Chapra in Marhowrah P.S. Case no. 46/2013. shahid (Hemant Kumar Srivastava,J) U T
