JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 07-02-2019 This appeal is for grant of pre-arrest bail to the appellant against the order dated 10.1.2019 passed by Special Judge, SC/ST Act, Gaya, in A.B.P. No. 4 of 2019, by which learned Special Judge has rejected prayer for pre-arrest bail of the appellant, who has been made accused in Barachatti P.S.Case No. 631 of 2018, registered under Sections 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code and Section 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against the accused persons, including the appellant is of abusing the informant by taking caste name and also of assaulting her and trying to outrage her modesty.
Submission of learned counsel for the appellant is that as a matter of fact he lodged a complaint about toddy business of the informant and as such he has been implicated in this case.

Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the appellant, rather he
Patna High Court CR. APP (SJ) No.449 of 2019 dt.07-02-2019 2/2 should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
