The petitioner has filed the instant application for grant of regular bail in connection with Dariyapur P.S. Case No. 641 of 2022 registered under sections 341, 342, 323, 384, 386 and 34 of the Indian Penal Code.

Prosecution case relates to demand of ransom money of 30,000/- from the informant, when he refused to pay the amount then they started abusing and assaulted him. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The name of the

Patna High Court CR. MISC. No.7724 of 2023(2) dt.12-04-2023 2/3 petitioner came into light in F.I.R. on the basis of disclosure made by the apprehended co-accused person. The petitioner was not apprehended on spot. It is further submitted that the ransom demand was not executed and the mobile number to which the informant was said to have transferred the so-called money of Rs. 5,500/- does not belong to the petitioner and he is no way concerned with the alleged offence. It is also submitted that except suspicion and confession made by other co-accused person, there is no material came against the petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 30.11.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Dariyapur P.S. Case No. 641 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the
