The petitioner is languishing in custody since 11.12.2018 in a case registered for the offences punishable under Sections 30(a) and 37(b),(c) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that from the house of the petitioner, 7 litres illicit country made liquor was recovered. It is submitted by learned counsel for the petitioner that the recovery is from the joint family house. It is further submitted that though the petitioner is accused in one other case but he is on bail in that case.

Learned APP submits that recovery has been made from the house of the petitioner.

Considering the quantity of recovery and the period

Patna High Court Cr.Misc. No.9013 of 2019(2) dt.15-02-2019 2/2 under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge -VII-cum-Special Judge, Excise Act, Aurangabad in connection with Goh P.S. Case No.276 of 2018.
