JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the State. Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite Court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 448, 504, 506, 341, 323, 307, 269, 354(B) and 330 of the Indian Penal Code, 8 of the Protection of Children from
Patna High Court CR. MISC. No.17548 of 2021(2) dt.13-12-2021 2/2 Sexual Offences Act, 2012, and 27 of the Arms Act, 1959. The prosecution case relates to assaulting, snatching the amount and urinating in the mouth of the daughter of the informant.
It is submitted that there is case and counter case. Both the parties have inimical term and both the parties are interested of alleged occurrence.
In the facts and circumstances of the case, the petitioners are entitled to get the privilege of bail. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge VI-cum-Special Judge, POCSO Act, Nawada, in connection with Roh P.S.
