Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 898 of 2022 lodged under Sections 302 and 34 of the I.P.C.

As per the prosecution case, there is an allegation of killing the deceased against the four unknown accused persons. From the contents of the F.I.R., it transpires that this F.I.R. has been lodged on hearsay statement.

Patna High Court CR. MISC. No.8541 of 2023(2) dt.03-05-2023 2/2 Learned counsel for the petitioners submit that antecedent of the petitioners are clean and they are in custody since 24.11.2022.

Learned counsel for the State opposes the prayer for bail and submits that upon reading the F.I.R., it transpires that the F.I.R. has been filed upon the hearsay statement. In the present facts and circumstances of this case and the submissions made above, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No. 898 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
