Learned counsel for the petitioner is directed to remove the defects, as pointed out by the Office, within a period of four weeks.
After some arguments, learned APP for the State has pointed out that from the order of the Sessions Court, it appears that process under Section 83 Cr.P.C. in connection with Complaint Case No. 159/2018 has already been issued against the petitioner.
In the said circumstances, learned counsel for the petitioner seeks permission to withdraw this application as the
Patna High Court CR. MISC. No.12367 of 2020(3) dt.28-02-2022 2/2 same is not maintainable.
Permission is accorded.
The present application stands disposed of. If the petitioner surrenders in the Court below and prays for bail, the same shall be considered on its own merit without being prejudiced by this order.
