Petitioner seeks bail in a case registered for the offences punishable under Sections 302,201,328,120B/34 of IPC.

The petitioner allegedly confessed before the Panchayat that she has poisoned to death to her husband. Thereafter, the dead body was recovered on disclosure statement of the petitioner. The reason for allegation is extra marital relation of the petitioner with some other man. Petitioner is in custody since 17.07.2018. The trial has not progressed since last refusal of prayer on 20.05.2019.

Considering no direct material against the petitioner and her custody as undertrial prisoner, let the petitioner, above

Patna High Court CR. MISC. No.20897 of 2021(2) dt.23-08-2021 2/2 named, who is a female, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.273 of 2019 arising out of Barachatti Police Station Case No.478 of 2018 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
