1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Ballia Police Station Case No. 178 of 2024, dated 06.06.2024, disclosing offences under Sections 363/366A/34 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that co-accused Mokhtar @ Ladla kidnapped minor girl of the informant, namely, Muskan Khatoon, for the purpose of marriage on 22.05.2024, in the night at about 10:00 PM, with the help of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in the present

Patna High Court CR. MISC. No.7474 of 2025(3) dt.13-05-2025 2/3 case merely because he happens to be the friend of the coaccused Mokhtar @ Ladla. He next submits that the gril was recovered by the police and in her statement recorded under Section 164 of the Code of Criminal Procedure, she has disclosed her age as 18 years and has said that due to conflict with her mother, she left her home on 22.05.2024 voluntarily. Thereafter she boarded train at Begusarai and went to Bangalore and worked in a hotel. Where she met with co-accused Mokhtar @ Ladla with whom she has solemnized marriage on 25.03.2025 at Bangalore and came to Kolkata to celebrate Eid, where she was arrested by the police and produced before the Court.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.7474 of 2025(3) dt.13-05-2025 3/3 each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia Police Station Case No. 178 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
