The petitioner seeks bail in Majhauliya P.S. Case no. 159/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. It is alleged that on account of child dispute the petitioner along with others came. On the order of the petitioner Banarsi Yadav and Baliram, Birbal Yadav is said to have pierced in the chest of Rajbanshi Yadav. Rajbanshi Yadav got one pierce injury on his chest and he died. There is no allegation of assault against the petitioner. The petitioner is in jail since 12.06.2015. Learned counsel for the informant as well as learned Additional P.P. opposed the prayer for bail.

No.43566 of 2015 (2) dt.21-09-2015 2/2 Considering the facts aforesaid and that fact that the petitioner is an order-giver, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Majhauliya P.S. Case no. 159/2015.
