Case No. 877 of 2024 and accordingly, they are being heard together and disposed of with this common

2. Heard learned counsel for the petitioners and learned APP for the State.
3. The petitioners are apprehending their arrest in Ram Krishna Nagar P.S. Case No. 877 of 2024 registered under Sections 126(2), 115(2), 351(2), 74, 76, 109, 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023.
4. According to allegation, marriage of the informant was solemnized with Anshu Kumar in the year, 2016. The accused persons started to torture her and the atrocities were intensified after birth of a male child in the year, 2017. The informant also made allegation of illicit relation of her husband with another lady. The description of implication of atrocities in various ways has been incorporated in the F.I.R. On 05.11.2024, the accused persons badly assaulted the informant in respect of which, video clips were snapped.
5. Learned counsel for the petitioners submits that they are innocent and have falsely been implicated in the present case. The petitioner Anshu Kumar is husband of the victim whereas petitioners Arun Kumar and Sushma Singh are father-in-law and mother-in-law of the victim/informant. On earlier occasion also, two cases were lodged by the informant against her husband and
3/4 the parents in-laws: The first case is Danapur P.S. Case No. 408 of 2016 and the second one is Kako P.S. Case No. 177 of 2021. In both the cases, similar allegations were levelled and in both the cases, all the three petitioners have been granted either regular or anticipatory bail. It has further been submitted that the members of prosecution side including the father and the brother of the informant came to the house of the petitioners and they badly assaulted the family members of the petitioners who suffered grievous injuries and in this respect, Ramkrishna Nagar P.S. Case No. 169 of 2021 was lodged and father of the informant remained under custody for more than a year in that case. The informant and her brother are also accused in that case and the brother of the informant is still absconding in that case. Learned counsel has also submitted that injuries are simple in nature caused by hard and blunt substances.
6. On the other hand, learned counsel for the informant opposed the prayer for bail by submitting that the accused persons brutally assaulted the victim and he suffered injuries. Learned counsel has also submitted that in this regard, this Court called for the injury report from P.M.C.H., Patna which has been received and perusal of the same shows that the injuries are caused by hard and blunt substances, which are
4/4 simple in nature. There is case and counter case between the parties. Two cases have already been lodged on behalf of the informant/victim in which the petitioners have been granted either regular bail or anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class-15/concerned court, Patnain connection with Ram Krishna Nagar P.S. Case No. 877 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
