Panday (APP) ====================================================== CORAM: HONOURABLE THE ACTING CHIEF JUSTICE ORAL ORDER 30-09-2015 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Kailu Kumar, in connection with Amarpur Police Station Case No.227 of 2014, under Section 399, 402, 414/34 of the Indian Penal Code and Sections 25(1-b)a /26/35 of the Arms Act, pending before the learned Chief Judicial Magistrate, Banka.

Perused the above application and materials on record.

Heard Mr. Avinash, learned Counsel for the petitioner, and Mr. Sunil Kumar Pandey, learned Additional Public Prosecutor, appearing on behalf of the State. Having regard to the nature of incriminating materials, which have been unearthed against the petitioner,

Patna High Court Cr.Misc. No.45411 of 2015 (2) dt.30-09-2015 2/2 coupled with the fact that the petitioner is an accused in a number of cases of similar nature, this Court is of the view that at this stage, the accused above-named shall not be allowed to go on bail.

In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. This bail application shall stand disposed of accordingly.
