JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-05-2019 Petitioner in this case is aggrieved by the recommendation made by the Block Supply Officer, Sanhaula to the Sub-Divisional Officer, Kahalgaon as also the communication made by the Sub-Divisional Officer, Kahalgaon to the District Supply Officer, Bhagalpur by which they have recommended the case of the petitioner for rejection of his claim to be appointed on compassionate ground.

Learned counsel for the petitioner submits that the recommendation is still pending consideration with the District Magistrate who is the Chairman of the District Selection Committee, Bhagalpur. Because of the recommendations as stated above, the petitioner has been made to believe that his

Learned counsel for the State submits that instead of keeping this writ application pending before this Court, an appropriate direction may be issued to the District Magistrate, Bhagalpur to look into the grievance of the petitioner and take an appropriate decision thereon.

In the given facts and circumstances of the case, this Court grants liberty to the petitioner to submit his objection before the Chairman-cum-District Magistrate, District Selection Committee, Bhagalpur (respondent no.2) within a period of three weeks from today and on the petitioner's submitting his objection, the respondent no.2 shall consider the same keeping in mind the relevant provisions of the Bihar Targeted PDS (Control) Order, 2016 and the judicial pronouncements on the subject and only after considering the objection of the petitioner an appropriate decision will be taken on the recommendation of the authorities concerned.
