The petitioner is languishing in custody since 18.02.2015 in connection with Mirganj P.S. Case No.46 of 2015 for the offences instituted under Section 393 of the IPC.

The prosecution story, in brief, is that three miscreants entered into the shop of the informant and on the point of pistol they tried to loot the cash but in the meantime, informant tried to come out from the shop then miscreants fired. After hearing the sound of firing, public came then out of three miscreants, two fled away and one was apprehended who disclosed the name of this petitioner.

Chargesheet has been submitted in the case. There is no allegation of tempering of evidence against the petitioner. The petitioner has falsely been implicated in the present case due to mistake of fact. Petitioner has remained in custody for a period of nine months.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Mirganj P.S. Case No.46 of 2015. (Sudhir Singh, J) Sanjeev/- U
