Petitioner is not named in the first information report but admittedly, neither informant nor any other witness has seen the actual killing of the deceased and it is only stated that when the informant reached near a hut from which dead body of the deceased was recovered, this petitioner gave information to the informant that the deceased was sleeping in the said hut but when the informant went into the hut, she found her husband's dead body lying on Machan and cause of death is said to be strangulation.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Raxaul in Darpa P.S.
