JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with K. Hat P.S. Case No. 714 of 2018, disclosing offences under Sections 420/34 of the Indian Penal Code, Sections 62, 64 of the Copy Right Act and Sections 103/104 of the Trade Mark Act.

Allegation as per F.I.R. is that an agent of Castrol E.I.P.R. India Pvt. Ltd. raided the shop of the petitioner and found one liter duplicate mobil, which was kept in a plastic bottle Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he is not the owner of the garage and does not know about the same. Further, he has no criminal antecedent. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, in connection with K. Hat P.S. Case No. 714 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
