JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-02-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The present writ petition involves the issue of discrimination in the matter of grant of senior grade pay scale with effect from 01.04.1981.

Learned counsel for the petitioner submits that similarly circumstanced teachers as mentioned in paragraph 2 of the writ petition have been granted the same benefits but the petitioner has been discriminated.

Without going into the merits of the writ petition whether the petitioner is entitled to aforesaid pay scale with effect from 01.04.1981 or not, the writ petition is disposed of

Patna High Court CWJC No.3012 of 2020(2) dt.24-02-2020 2/2 with a direction to the District Programme Officer (Establishment), Chapra (Saran) (respondent no. 4) to verify the record and on verification of the records if it is found that the case of the petitioner stands on similar footing, like teachers of Primary School, Matiyan Anchal Manjhi-2 as mentioned in paragraph 2 of the writ petition, then the benefit of such pay scale may be extended to this petitioner. Necessary decision in this regard shall be taken by the respondent after verification of the records within a period of three months from the date of receipt/production of a copy of this order.
