JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned Special Public Prosecutor for the State. The allegation against the petitioner is that he entered the premises of the school in inebriated condition and not only abused the teachers but also assaulted the children of the aforesaid school.

The submission on behalf of the petitioner is that the petitioner had raised voice against the irregularities committed by the teachers of the aforesaid school in connection with distribution of midday meal resulting in false implication of the petitioner in the present case. Moreover, the petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.44906 of 2015 (2) dt.28-09-2015 2/2 as well submissions of the parties, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 58 of 2015/5 of 2015 arising out of Baruraj P.S. Case No. 103/2014 to the satisfaction of the 1st Additional Sessions Judge-cum-Special Judge, SC/ST Act, Muzaffarpur.
