Petitioner is seeking anticipatory bail in connection with Raniganj P.S. Case No. 298 of 2018, G.R. No. 2902 of 2018 dated 09.09.2018 registered for the offences punishable under Sections 341, 323, 324, 326, 307 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that as per allegations three persons were there on the motorcycle on the alleged date of occurrence when one of them namely, Govinda Thakur had penetrated knife in the stomach of the brother of the informant. The allegation against the petitioner is that he had fled away leaving behind his motorcycle at the place of occurrence. Learned counsel for the petitioner submits that the

By filing a supplementary affidavit the petitioner has stated that he is a acid victim and has lost both the eyes. He has been granted a compensation of Rupees Three Lacs from the Secretary, District Legal Services Authority, Araria as compensation due to his blindness. In such circumstances, it is submitted that the allegations impleading this petitioner is totally false.
Learned APP for the State is present. He has opposed the prayer for anticipatory bail and submits that save and except the general allegations there is no other materials. In the given facts and circumstances, considering that the allegation of penetrating knife is against one Govind Thakur and the petitioner is said to be a blind person who has been awarded compensation by the Secretary, District Legal Services Authority, in case of arrest or surrender of the petitioner, namely, Munna Thakur within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Araria in connection with Raniganj P.S. Case No. 298 of 2018, G.R. No.2902 of 2018,
Patna High Court Cr.Misc. No.8227 of 2019(2) dt.15-02-2019 3/3 subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
