JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This is an application for grant of anticipatory bail in connection with Madhuban P.S. Case No. 199 of 2018, disclosing offences under Sections 379 and 420 of the Indian Penal Code.

Allegation as per F.I.R. is that police received an information that some miscreants are engaged to commit theft in the India No.1 ATM booth and on that information police reached the place of occurrence and apprehended one Deepak Kumar Sahani and petitioner succeeded in fleeing away and 6 ATM cards were also recovered from the possession of arrested person.

Submission of learned counsel for the petitioner is that he has been named by the other co-accused person and nothing has been recovered from the possession of the

Patna High Court CR. MISC. No.11578 of 2019(3) dt.29-04-2019 2/2 petitioner, though he is accused in one more case, but he is on bail.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation and criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court. Accordingly, this application is dismissed.
