JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is not named in the FIR but in the course of investigation co-accused Raghubir Tanti confessed his guilt disclosing the name of the petitioner and others. Subsequently, the confessional statements of the petitioner as well as others were taken. Apart from the above stated confessional statements, the I.O. has collected one circumstance also against the petitioner. It is said that mobile phone of the petitioner and deceased were recovered from Marshal Jeep which had been used in the commission of the crime. Considering the aforesaid facts and circumstances
Patna High Court Cr.Misc. No.44786 of 2015 (2) dt.28-09-2015 2/2 as well as submissions of the parties, particularly taking note of the fact that none has seen the actual killing of the deceased, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Cheriya Bariarpur P.S. Case No. 61 of 2015 to the satisfaction of the Chief Judicial Magistrate, Begusarai.
