Petitioner is not named in the first information report but in course of investigation on the basis of tower location of looted mobile, police interrogated one Maro Devi who disclosed that her sim card was being used by her son, namely, Sujit Kumar and when Sujit Kumar was interrogated, he disclosed that looted mobile and sim were purchased by his brother who prior to the above stated purchase had gone to different places along with the petitioner and some others. It appears that except the aforesaid material as well as criminal antecedent of the petitioner, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
