JUSTICE SUDHIR SINGH ORAL ORDER 10-11-2015 Heard the learned counsel for the petitioner and the learned counsel for the State.
The petitioner is languishing in custody since 27.06.2014 in connection with Bathnaha P.S. Case No.138 of 2012 for the offences instituted under Sections 302/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that on 07.10.12 at about 10.30 P.M. 3-4 unknown miscreants came at the gate of the house of the informant and committed murder of his wife Jayanti Devi by fire-arm.
It is submitted on behalf of the petitioner that the petitioner is in custody since 27.06.2014. Chargesheet has been submitted in the case. There is no allegation of tempering with evidence
Patna High Court Cr.Misc. No.43590 of 2015 (3) dt.10-11-2015 2/2 against the petitioner. The petitioner is not named in the FIR. In course of investigation, some of the witnesses have stated that the petitioner was seen fleeing away from the place of occurrence. It is at best the case of last seen.
On behalf of the State, it is submitted that the name of the petitioner has come in the course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge Ist, Sitamarhi in connection with Bathnaha P.S. Case No.138 of 2012.
