The petitioner seeks pre-arrest bail in connection with Garkha P.S. Case No.385 of 2019 for the offence punishable under Sections 149, 341, 323, 354, 379 and 504 of the Indian Penal Code.

It is contended that on a trivial dispute of passage of drain water, the informant concocted a false case and implicated the mother, father and three sisters of the petitioner in the instant case. It is further contended that the ingredients of outraging of modesty of the informant are not attracted in the present case.

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner.

No.5710 of 2020(2) dt.04-03-2020 2/2 Considering the nature of allegation as also the fact that the petitioner is a next door neighbour and has got no criminal antecedent, in the event of arrest or surrender in the court below within a period of six weeks, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XIV, Saran at Chapra in connection with Garkha P.S. Case No.385 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
