The petitioner is apprehending his arrest in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a)(d) of Bihar Prohibition and Excise Act in connection with Atri P.S. Case No.405 of 2018 pending in the Court of Learned Special Judge Excise, Gaya.
As per the prosecution case, accusation is of recovery of two litres of illicit country made Mahua liquor from the house of the petitioner.
It is submitted by learned counsel for the petitioner that the house from which, the recovery has been made is a joint family house. Statement has been made in paragraph no.3 that the petitioner is not having any criminal antecedent. Considering the quantity of liquor recovered, it is a

Accordingly, the petitioner is directed to surrender before the concerned court below and pray for regular bail and if any such application is preferred, the court below after considering the quantity of recovery shall disposed of the same, if possible on same day, without being prejudiced by this order of the Court.
