It is contended on behalf of the petitioner that vide Annexure 1, the District Magistrate, Vaishali has passed the order that licence of the petitioner would not be renewed and at the same time was pleased to cancel the same also. The aforesaid order was put to challenge by filing Arms Appeal No. 10 / 2015 in which order was passed on 23.02.2015 by the Commissioner, Tirhut Division, Muzaffarpur setting aside the order of the licensing authority and remanding the matter for taking a fresh decision. However, since then, no order has been passed by the licensing authority. In above view of the matter, this writ application is being disposed of, without going into the merit of the case, with a direction

Patna High Court CWJC No.11196 of 2016 dt.01-08-2016 2 / 2 to the District Magistrate-cum-Licensing Authority to take a final decision in the matter of the petitioner on its own merit and in accordance with law within a period of three months from the date of receipt/production of a copy of this order, if the same has already not been taken.
