The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 323, 353, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner along with some other persons is to have abused, threatened and assaulted the informant and his team while they were carrying out the work of re-conducting under the Saat Nishchay Yojna of the Chief Minister.
It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. It is further submitted that informant and his team started reconducting the work on the land of the petitioner and when
Patna High Court CR. MISC. No.6751 of 2020(2) dt.01-10-2020 2/3 petitioner opposed and advised them to conduct the work on public land, they denied and wanted to do the work forcefully. It is further submitted that petitioner has not used any force upon the informant and his team rather he took legal remedy for the same by filing complaint on 09.11.2019 before the SubDivisional Public Complaint Redressal Officer, Sherghat, Gaya. Petitioner has no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Amas P.S. Case No.209 of 2019, corresponding to G.R. No.1490/2019 subject to the condition as laid down under Section 438(2) of the Cr.P.C with following conditions:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and his
