The petitioners apprehend their arrest in a case registered for the offence under Sections 147/149/341/323/307 / 379/504/506 of the Indian Penal Code.

As per F.I.R., the allegation against petitioner no. 1 and petitioner no. 2 is of commission of assault with Farsa to nephew and brother of informant respectively. It is submitted on behalf of petitioners that though,

Patna High Court CR. MISC. No.9584 of 2023(2) dt.25-04-2023 2/2 there is allegation of commission of assault against petitioners no. 1 and 2, but the doctor has found simple injury. So far as other petitioners i.e. petitioners no. 3 to 6 are concerned, there is general and omnibus allegation and so specific allegation of overt act has been alleged against them. Petitioners have got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge - IX, Madhubani in connection with Benipatti P.S. Case No. 265 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
