The petitioner is languishing in jail since 07.07.2015 in a case instituted under Sections 304(B)/34 of the Indian Penal Code.

As per prosecution case, the daughter of the informant married with Bhavesh Thakur on 13.06.2014 and on 26.03.2015 in the night he was informed by some of the villagers that the petitioner as well as the family members assaulted and set fire his daughter by sprinkling kerosene oil and during course of treatment she died in the hospital.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.07.2015. Chargesheet has

Patna High Court Cr.Misc. No.43460 of 2015 (3) dt.10-11-2015 been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal antecedent. Petitioner is the father-in-law of the deceased. He is separate in mess and property from the husband of the deceased. It is said to be an accidental death. While the deceased was cooking, she accidentally sustained burn injuries.

On behalf of the State, it has been submitted that the petitioner is named in the FIR and have actively participated in the alleged occurrence.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Minapur P.S.Case No.93 of 2015.
