The petitioner seeks bail in a case registered under Section 302/34 of the Indian Penal Code.

The prosecution case in brief is that in the backdrop of petty issue, the dispute arose and in consequence thereof, the accused persons assaulted the brother of the informant, as a result of which, he died.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-08-2018. Charge sheet has already been submitted. No external injury was found on the body of the deceased. Gun has not been used at the time of occurrence. Butt of the gun is said to have been

Patna High Court CR. MISC. No.7378 of 2019(3) dt.23-04-2019 2/2 used. None of the accused persons had any intention to commit the murder. As per postmortem report, there is injury in the intestine. According to FIR, Pintu Kumar is said to have assaulted on the stomach of the deceased.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Danapur in connection with Maner P.S. Case No. 384 of 2018.
