The petitioner seeks bail in Dehri (T) P.S. Case No.518 of 2018, registered under Sections 30(a) (b)/38/41/44/47/48 of the Bihar Prohibition and Excise Act. The informant intercepted a car and apprehended three persons, namely, Bhagwan Sahay Verma, Anil Kumar and Anita Devi. They disclosed that on the order of Appu Sharma and Satya Sharma, who called their owner, they brought the consignment.
Learned counsel for the petitioner submits that 128.73 litres of foreign liquor of different brands was recovered from the apprehended accused who brought the same on a vehicle. They disclosed the name of Appu Sharma and the petitioner, Satya Sharma, but there is no tangible evidence to show that the

Anita Devi and others have already been granted regular bail by a Bench of this Court vide order dated 16.07.2018, passed in Cr. Misc. No.44513 of 2018. Appu Sharma has been granted anticipatory bail vide order dated 20.08.2018, passed in Cr. Misc. No.50833 of 2018. The case of the petitioner stands on the same footing. Taking into consideration the facts aforesaid, petitioner, namely, Satya Sharma is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Rohtas, Sasaram in connection with Dehri (T) P.S. Case No.518 of 2018.
