Petitioner seeks regular bail in connection with POCSO Case No. 29 / 2020 arising out of Karai Parsurai PS Case No. 42 of 2020 registered for the offence under Sections 363 / 366 (A) / 365 / 34 of the IPC Section and Section 8 / 12 of the POCSO Act.

The allegation is that the petitioner abducted the minor daughter of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as victim was having love affair with the petitioner and during the course of trial the statement of the victim girl was recorded and from perusal of the same ( Annexure -2 to the supplementary affidavit) it would be evident that victim girl has stated that she

Patna High Court CR. MISC. No.7240 of 2022(2) dt.26-05-2022 2/2 had left her house voluntarily and has performed marriage with the petitioner and she has been living happily in her matrimonial home along with the petitioner. The petitioner is in custody since 30-11-2021.

Regard being had to the submissions made by the parties, taking into consideration the deposition of the victim girl recorded during the course of trial (Annexure -2 to the supplementary affidavit), the fact that petitioner is in custody since 30-11-2021 and charge sheet has already been submitted , as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned VIIth Additional Sessions Judge-cumSpecial Judge, POCSO, Nalanda, Biharsharif in connection with POCSO Case No. 29 / 2020 arising out of Karai Parsurai PS Case No. 42 of 2020.
