JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Barari P.S. Case No. 200 of 2018, disclosing offences under Sections 341, 323, 354, 302, 504, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per F.I.R. is that the petitioner caught hold the brother of the informant and thereafter other accused persons fired upon him.

Submission of learned counsel for the petitioner is that the allegation against the petitioner is only of caught hold of the deceased and the allegation of firing is against other accused persons.

Heard learned A.P.P. also.

Having heard both sides, considering facts and circumstances of the case and active involvement of the

Patna High Court Cr.Misc. No.7827 of 2019(2) dt.13-02-2019 2/2 petitioner, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
